Cities and counties may reduce cash benefits to an asylum-seeker according to a ruling by the Osnabrück Social Court if they have already applied for asylum in another country.
The court in a ruling on Tuesday rejected the lawsuit of a Sudanese against the reduction in his benefits by the Osnabrück district. He had first applied for asylum in France.
It is crucial that the asylum application made in Germany is inadmissible, since the country of first entry into the EU is responsible for an asylum application according to the so-called Dublin procedure, the court said.
The reduction in benefits could be seen as a way to pressure the affected to voluntarily return to France. (Casefile: AZ: S 44 AY 76/19 ER)
